Brett Thorsteinson focuses on helping people through divorce as quickly and efficiently as possible. Every divorce is unique, and it is essential to consider the best strategy and approach for the specific situation.

Thorsteinson Law Group and Brett Thorsteinson are pleased to announce that the Long Beach divorce attorney identifies the specific aspects that make each divorce unique. These factors are used to develop a strategy to ensure that the divorce proceedings are as easy and fair as possible. Even in an uncontested divorce, the emotional and financial impact on the client can be significant. Brett works to resolve any issues with care and compassion. He will advocate for the best interests of his client and any children involved. His efforts aim to meet the client’s needs during the divorce process and find a lasting resolution so that it is possible to continue with life without the distraction of unresolved issues.

California is a ‘no-fault’ divorce state, so each spouse is equally responsible for 50% of the marriage. Assets and debts are divided equally. Other issues, such as spousal support and child custody, are negotiated and worked out through divorce. The three types of proceedings are related to divorce actions. These are Uncontested, Contested, and Legal Separation. A legal separation is not required for a couple to live apart. Still, a carefully considered separation agreement can address issues such as child custody, the payment of support, and property division. Whether a separation ultimately leads to divorce or reconciliation, a legal separation agreement can pave the way for a peaceful resolution.

An uncontested divorce is a legal settlement where both parties agree regarding all the issues or when one party chooses not to participate in the divorce process. There are no disputes over support, division of property, or child custody, and the couple agrees to the terms of the divorce without the need for a trial.

A contested divorce is one in which the couple cannot agree on issues such as child custody, division of property, and spousal support. When an acceptable agreement is not reached through mediation or negotiation, it becomes necessary to go to trial to protect the client’s best interests. Brett handles all filings and requirements to reduce emotional and financial stress.

Grounds for a divorce or a legal separation are the same. Either judgment may be had on the no-fault basis of irreconcilable differences, and it is not necessary to prove that one party is at fault in some way for ending the relationship. The residency requirement is not an issue in a legal separation, but the break must be consensual to be granted.

Other actions that must be completed during the process can include obtaining a temporary court order by submitting an Order to Show Cause hearing, Discovery, and Preparation of the Preliminary Declaration of Disclosure. If an agreement between the two parties resolves the case, one of the legal team members prepares the Marital Settlement Agreement, which includes all of the terms of the deal.

A trial will occur if the parties cannot agree on all the issues in the case. If both parties sign the Marital Settlement Agreement or after the trial is finished, one of the legal team members prepares a Judgment of Dissolution of Marriage that contains all of the court’s orders. The judgment is filed, and the court provides each lawyer a Notice of Entry of Judgment.

In California, parties must wait six months before the divorce is finalized. The exception is a summary dissolution, when parties have no children, have been married for less than five years, don’t own real estate, and have relatively limited property and debts. Some paperwork still needs to be filed, but it is unnecessary to wade through many procedures and appearances required for a regular divorce.
