The data indicates “clear trends” of fraudulent activities, spurred by the ongoing cost of living crisis in England and Wales.

The OIC report sheds light on the emergence of non-tariff injuries and the involvement of professional enablers in orchestrating cynical ‘conveyor belt’ processes to maximise entirely fabricated or exaggerated injury claims.

The rise in opportunistic fraud is not solely limited to made-up claims; there is also evidence of a phenomenon known as “claims creep,” where genuine claims are inflated or exaggerated for financial gain.

“The difficulty lies in the fact that many claims are genuine but exaggerated for financial gain. Claimants will often exaggerate psychological injuries to get more from their claim,” added Samiara, emphasising the complexities involved in distinguishing genuine claims from fraudulent ones.

The report highlights that the impact of the recently introduced FRCs (Flexible Recoverable Costs) remains to be seen, as it should theoretically help reduce costs. However, its practical effect on combating fraudulent activities will require further monitoring.
